AIMEXPERT TERMS OF SERVICE AND SOFTWARE LICENCE AGREEMENT

PLEASE READ THESE TERMS CAREFULLY.
By creating an AimExpert account, accessing the AimExpert website or forums, purchasing or receiving a subscription, downloading or using the AimExpert loader, accessing an AimExpert product, or otherwise using an AimExpert service, you agree to these Terms of Service and Software Licence Agreement ("Terms").
If you do not agree to these Terms, you must not create an account, access or use the Software, or use AimExpert services.
1. DEFINITIONS
"AimExpert", "we", "us" and "our" refer to the operator of the AimExpert service.
"Services" means the AimExpert website, forums, account system, subscription services, APIs, loader, software delivery infrastructure and related services.
"Software" means the AimExpert loader and any software, executable, module, component, update or other material made available through AimExpert.
"Product" means any software product made available through the AimExpert Services.
"Account" means a registered AimExpert/MyBB user account.
"Subscription" means an entitlement, whether paid, promotional, complimentary, trial, lifetime or otherwise, that permits access to one or more Products.
2. ELIGIBILITY AND ACCEPTANCE
You may use the Services and Software only if you are legally capable of entering into these Terms.
By registering an Account or using the Services or Software, you confirm that you have read, understood and agreed to these Terms.
You are responsible for ensuring that your use of the Services and Software complies with laws and regulations applicable to you.
3. LIMITED SOFTWARE LICENCE
Subject to these Terms and while you hold any required active Subscription, AimExpert grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the applicable Software.
You do not acquire ownership of the Software.
All rights not expressly granted under these Terms are reserved.
Access to the Software may depend upon continued authentication, account status, device authorisation, an active Subscription and other security or licensing requirements.
4. RESTRICTED PERSONS AND ORGANISATIONS
Unless AimExpert has provided prior written authorisation, the Services and Software are not licensed for access or use for the purpose of investigating, analysing, detecting, monitoring, disrupting, reverse engineering, circumventing or developing countermeasures against AimExpert or its Software.
This restriction includes persons acting for or on behalf of:
- game developers or publishers;
- anti-cheat developers, providers or operators;
- software-security or anti-tamper vendors;
- competitors of AimExpert;
- investigators, contractors, consultants or researchers engaged by any of the above for the prohibited purposes.
Without limiting the above, no licence is granted for such purposes to persons acting for or on behalf of Valve Corporation, Valve Software, BattlEye Innovations, Epic Games, Easy Anti-Cheat, or their respective affiliates, contractors or agents.
The organisations identified above are examples only. This restriction applies according to the purpose and capacity in which access is obtained, regardless of whether an organisation is expressly named.
Nothing in these Terms excludes any activity or right that cannot lawfully be excluded or restricted.
5. PROHIBITED ACTIVITIES
Except where expressly authorised by AimExpert or where a restriction cannot lawfully apply, you must not:
- reverse engineer, decompile, disassemble, debug or otherwise attempt to derive the source code, internal implementation or protected operation of the Software;
- dump, extract, decrypt, capture, reproduce or redistribute protected Software or its components;
- modify, patch, hook, instrument or tamper with the Software for the purpose of bypassing its security, licensing or access controls;
- bypass, disable, interfere with or circumvent authentication, Subscription checks, device restrictions, runtime authorisation, integrity checks or other security mechanisms;
- intercept, replay, forge, fabricate or manipulate authentication, authorisation, licensing or entitlement communications;
- attempt to obtain or derive private cryptographic keys, authentication credentials, access tokens, protected server material or other secrets;
- inject unauthorised code into the Software for the purpose of circumventing its protections;
- create, distribute or facilitate a cracked, modified or unauthorised version of the Software;
- redistribute, resell, sublicense, lease, share or otherwise provide the Software or your access to another person unless expressly authorised by AimExpert;
- share, sell, transfer or otherwise permit another person to use your Account or Subscription;
- scrape, probe, scan, attack, overload or attempt unauthorised access to AimExpert servers, APIs or infrastructure;
- use automated systems to abuse registration, promotional offers, subscriptions or other Services;
- intentionally assist another person in performing an activity prohibited by these Terms.
6. ACCOUNTS
You are responsible for maintaining the confidentiality and security of your Account credentials.
Accounts are personal unless AimExpert expressly agrees otherwise.
You must provide accurate information where information is required for account administration, payment or support.
You must promptly notify AimExpert if you reasonably believe your Account has been compromised.
AimExpert may implement security measures intended to detect account sharing, unauthorised access, fraud or circumvention.
7. DEVICE AUTHORISATION
AimExpert may restrict a Subscription or Account to a permitted number of authorised devices.
The Software may derive a cryptographic device identifier for licensing, security, fraud-prevention and enforcement purposes.
Changing hardware, reinstalling an operating system or making other substantial system changes may affect device recognition.
Device resets or changes may be subject to limitations or manual review.
Attempting to manipulate or falsify device identity for the purpose of circumventing restrictions is prohibited.
8. SUBSCRIPTIONS
Access to particular Products may require an active Subscription.
Subscription duration and Product access are determined by the entitlement associated with your Account.
Subscriptions may include paid, complimentary, promotional, trial or other access.
Promotional or complimentary Subscriptions have no cash value and may be subject to additional eligibility requirements.
AimExpert may prevent abuse of promotional offers, including attempts to obtain multiple offers through multiple Accounts or manipulated device identities.
Expiry of a Subscription terminates the licence to access the Products covered by that Subscription unless renewed or otherwise extended.
9. SOFTWARE DELIVERY AND UPDATES
AimExpert may update, replace, modify or discontinue versions of the Software.
Users may be required to use a current version of the AimExpert loader or Product.
Software compatibility may be affected by changes to third-party software, operating systems, games or other external systems.
AimExpert does not guarantee that a Product will remain compatible with every future version or update of third-party software.
10. SECURITY AND RUNTIME AUTHORISATION
AimExpert may use authentication, device authorisation, cryptographic verification, runtime authorisation, integrity verification and other technical controls to protect the Services and Software.
Access may be periodically re-authorised while Software is running.
Failure or refusal of an authorisation check may cause protected functionality or Software to stop operating.
You must not intentionally interfere with these controls.
11. SUSPENSION AND TERMINATION
AimExpert may suspend or terminate an Account, Subscription, device authorisation, active session or access to the Services where we reasonably believe:
- these Terms have been breached;
- an Account or Subscription has been shared, sold or transferred without permission;
- security or licensing controls have been circumvented or attacked;
- fraudulent or abusive activity has occurred;
- access presents a security risk to AimExpert, its users or infrastructure; or
- suspension is reasonably necessary to protect the Services or investigate suspected misuse.
Serious security violations may result in immediate suspension or termination.
Termination of access does not grant permission to retain, distribute, analyse or continue using protected Software.
12. INTELLECTUAL PROPERTY
The Software, Services, branding, designs, documentation and associated intellectual property remain the property of their respective owners.
No provision of these Terms transfers ownership of AimExpert intellectual property to you.
The limited licence granted under these Terms exists only while you comply with these Terms and satisfy applicable access requirements.
13. THIRD-PARTY SERVICES AND SOFTWARE
AimExpert is an independent service.
Unless expressly stated otherwise, AimExpert is not affiliated with, endorsed by, sponsored by or approved by any game developer, publisher, platform operator or anti-cheat provider.
All third-party names, trademarks and products remain the property of their respective owners.
Your use of third-party software or services may be governed by separate agreements between you and those third parties.
You are responsible for understanding the consequences of using the Software with third-party services.
14. RISK OF USE
Software interacting with third-party games or services may be detected, restricted or otherwise acted upon by those third parties.
Use of the Software may result in consequences including restrictions or suspension of access to third-party accounts or services.
You accept these risks when choosing to use the Software.
AimExpert does not guarantee that Software will be undetectable, uninterrupted, error-free or compatible indefinitely.
15. PAYMENTS, CANCELLATIONS AND REFUNDS
Prices, Subscription periods and applicable Product access will be displayed at the time of purchase.
Except where required by law or expressly stated otherwise, access already supplied or consumed may not be refundable merely because a user changes their mind, no longer wishes to use the Product, or experiences action by a third-party service.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Consumer Law.
Additional payment, cancellation and refund conditions may be specified in AimExpert's Refund and Cancellation Policy.
16. AVAILABILITY
AimExpert may temporarily suspend Services for maintenance, security incidents, updates or circumstances outside our reasonable control.
We do not guarantee continuous or uninterrupted availability.
We may discontinue a Product or Service. Where applicable, any rights or remedies required by law remain unaffected.
17. DISCLAIMER
To the maximum extent permitted by law, the Services and Software are provided without guarantees beyond those that cannot lawfully be excluded.
AimExpert does not warrant that the Software will:
- operate without interruption or error;
- remain compatible with third-party software indefinitely;
- avoid detection by third-party systems;
- satisfy every user's particular requirements; or
- remain available in its present form.
Nothing in these Terms excludes statutory guarantees or other rights that cannot lawfully be excluded.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by law, AimExpert is not liable for indirect, incidental, special or consequential loss arising from use of or inability to use the Services or Software.
This includes, to the extent permitted by law, loss resulting from actions taken by third-party platforms or services.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
19. PRIVACY
Use of the Services is also subject to the AimExpert Privacy Policy.
The Privacy Policy explains the types of information AimExpert may collect, how that information is used and protected, and the circumstances in which it may be disclosed.
By using the Services, you acknowledge that you have been provided access to the Privacy Policy.
20. CHANGES TO THESE TERMS
AimExpert may update these Terms from time to time.
The current version and effective date will be made available through the AimExpert website or Services.
Where a material change affects continued use of the Services, AimExpert may require users to accept the updated Terms before continuing to access protected Services or Software.
Continued use after valid notice and any required acceptance constitutes agreement to the updated Terms to the extent permitted by law.
21. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue to apply.
22. NO WAIVER
Failure by AimExpert to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision later.
23. GOVERNING LAW
These Terms are governed by the laws applicable in Switzerland.
Subject to any rights that cannot lawfully be excluded, disputes relating to these Terms are subject to the jurisdiction of the courts of Switzerland and applicable courts.
